Racing or high speed driving is inherently dangerous with significant risk of personal injury or even death. When a user participates in racing or track events, they accept the risk inherent therein. Racing or high speed driving is also very physically demanding and not everyone may be fit to drive a Track Attack vehicle. Hendrick Performance makes no warranty that the use of Track Attack vehicles guarantees personal safety or freedom from physical injury.
Track Attack vehicles are not for street, highway, or off-road use and are intended ONLY for use as track vehicles operated on closed-course facilities or race tracks with appropriate supervision of qualified individuals to ensure that the safety needs of the race driver and others are met.
Sanctioning bodies and tracks make an effort to provide participants with a relatively safe environment for everyone involved. Despite strict rule enforcement and strict rule adherence, all participants must be aware that their mere presence at a track event presents a chance of becoming critically or fatally injured, even by no fault of their own. There is no guarantee or implication that injuries or death will not occur.
IT IS IMPORTANT TO UNDERSTAND
Hendrick Performance Track Attack vehicles are sold “as is” without any warranty whatsoever. The entire risk of quality and performance of such vehicles lies with the buyer, user, or subsequent user.
It is the user’s responsibility to inspect and verify the integrity and performance of the entire vehicle and its components as being appropriate for competition prior to any actual use. Vehicles are to be inspected by the user before each use for evidence of damage, defect, or wear to ensure the vehicle is fit and ready for operation.
Should such vehicles or any components prove defective following their purchase, the buyer and not Hendrick Performance or any affiliate thereof assume the entire cost of all necessary services, repair or replacement.
Keeping in mind there is no guarantee to begin with, tampering or modification of any vehicle or components from their “as-delivered” state could compromise the integrity of the vehicle and safe operation thereof, as well as the safety of its driver.
Track Attack vehicles are not street legal or certified under federal motor vehicle safety standards and regulations and are neither intended nor certified for use on public roads.
